Terms & Conditions- Pink Summer Sale 2026

1. On purchase during the Pink Summer Sale 2026 (“Event”), the customer(s) may be entitled to free gifts / Gift Vouchers / rewards (“Giveaways”) upon meeting pre-defined eligibility criteria as specified at the sole discretion of Nykaa Fashion (operated by FSN E-Commerce Ventures Limited).
2. The Giveaways/Gift Vouchers are only valid for the Event and may not be valid in conjunction with any other offer or promotion, unless otherwise stated.
3. Giveaways are strictly merit-based. This means:
1. No lucky draw or random selection.
2. Eligibility is based on clear, pre-defined rules such as highest spender or meeting a Minimum Order Value (MOV) threshold.
4. The eligibility criteria, including spend thresholds, applicable products/brands, Event duration, and tie-breaker rules (if any), will be pre-defined and communicated in campaign materials. Customers are advised to review the same before participating. Nykaa shall not be liable for any customer’s failure to review such criteria.
5. Only one Giveaway / Gift Voucher will be issued per qualifying customer per defined eligibility criterion during the Event, unless otherwise expressly stated.
6. All Giveaways/Gift Vouchers are subject to availability (including but not limited to colour, size, variant, or model). In case of unavailability, the Participating Brand reserves the right to substitute the Giveaway with another product or benefit of equal or comparable value. Nykaa shall have no liability in relation to such substitution. Images and descriptions are indicative only; actual products may vary.
7. All Giveaways/Gift Vouchers under this Event are fully funded, sponsored, and fulfilled by the respective Participating Brands. Nykaa Fashion is only facilitating the promotion and shall not be responsible for the quality, merchantability, fitness for purpose, fulfilment, delivery, warranty, or any post-delivery issues related to the Giveaways. Any claims or grievances relating to the Giveaway shall be directed solely to the Participating Brand.
8. Gift Vouchers will be issued to customers only after the return/exchange window has closed, via the registered email ID provided by the customer. Gift Vouchers may contain additional terms and conditions of use issued by the Brand or third party; customers are required to comply with such terms. If the customer provides an incorrect or invalid email ID, Nykaa shall not be responsible for non-delivery, and no re-issuance shall be guaranteed.
9. Eligibility and winner determination (where applicable) will be finalized only after the expiry of the applicable return/cancellation/exchange window. Any returned, cancelled, exchanged, or modified orders shall be excluded from eligibility calculations. The net effective spend (post returns/cancellations) shall be the sole basis for determination.
10. The Giveaways/Gift Vouchers are non-transferable, non-assignable, and cannot be substituted for cash, credit, or any other item unless explicitly stated. Any attempt to sell, transfer, or commercially exploit a Giveaway shall render it void.
11. The Gift Voucher(s) does not cover delivery charges, packaging charges, convenience fee, tip amount, or any other extra charges applicable for order processing. These charges remain payable by the customer.
12. Third-party vouchers, memberships, or benefits (including but not limited to Spotify, BookMyShow, Zomato, Cult, salon passes, travel passes, or similar) are governed entirely by the respective third party’s terms and conditions. Nykaa Fashion shall not be responsible for redemption, service quality, validity, expiry, or any dispute with such third-party providers.
13. Any tax liability arising from the receipt of a Giveaway, including applicable Tax Deducted at Source (TDS) for rewards exceeding the statutory threshold under Section 194R of the Income Tax Act, 1961 (currently ₹10,000 in aggregate in a financial year), shall be the sole responsibility of the customer or as specified by the Participating Brand. Customers may be required to provide PAN and other details for compliance, failing which the Giveaway may be forfeited without any liability on Nykaa.
14. Nykaa makes no representation or warranty of any kind—express, implied, or statutory—in relation to free gifts/Giveaways provided. To the fullest extent permitted by law, Nykaa shall have no liability to the customer in relation to any Giveaway, its fitness for purpose, merchantability, or otherwise. In no event shall Nykaa’s aggregate liability exceed INR 100 (Rupees One Hundred only).
15. Purchases made using fraudulent means, including but not limited to stolen payment instruments, fake accounts, bulk/reseller purchases, or manipulation of the platform, shall be disqualified. Nykaa reserves the right to withhold or revoke any Giveaway in such cases without prior notice or liability.
16. By participating in the Event, the customer indemnifies and holds harmless Nykaa Fashion, its affiliates, directors, officers, employees, and agents against any and all claims, actions, damages, losses, expenses, or liabilities (including legal fees) arising out of or in connection with the customer’s participation in the Event, receipt or use of any Giveaway, or any breach of these Terms and Conditions.
17. By participating in the Event, the customer consents to the collection and use of their personal data (including name, email, phone number, purchase history, and PAN) for purposes including Event administration, eligibility verification, Giveaway fulfilment, and legal/tax compliance. Such data may be shared with Participating Brands and their service providers for these purposes and retained only for as long as necessary in accordance with applicable laws, including the Information Technology Act, 2000 and the Digital Personal Data Protection Act, 2023. 18. Nykaa shall not be liable for any delay or failure in performing its obligations under this Event due to circumstances beyond its reasonable control, including but not limited to acts of God, pandemic, government restrictions, or technical failures. In such events, Nykaa may cancel, suspend, or modify the Event without prior notice or liability.
19. Nykaa reserves the right to amend, modify, suspend, or terminate these Terms and Conditions or the Event at any time without prior notice. Customers are advised to review the same periodically for updates. Continued participation constitutes acceptance of revised terms.
20. In the event of any dispute, Nykaa’s decision shall be final and binding, to the extent permitted by law.
21. These Terms and Conditions shall be governed by the laws of India and the courts of Mumbai, Maharashtra shall have exclusive jurisdiction over any matters arising thereof.
